This Privacy Policy describes how Klou Co. (the "Company," "Kloü," "we," or "us") collects, uses, and protects information in connection with the Kloü waitlist, website at klou.app, and the Kloü mobile application (collectively, the "Service").
1. Information We Collect
We collect the following categories of information:
- Contact information — mobile phone number, first and last name, Instagram handle, and email address when you provide it.
- Consent records — the date, time, IP address, and exact consent language shown to you when you join the waitlist.
- Referral source — how you heard about Kloü, when you tell us.
- Usage information — basic analytics about how you interact with the Service.
2. How We Use Information
We use the information we collect to:
- Operate the waitlist and send you invite-related communications.
- Send SMS messages including signup confirmations, one-time verification codes, launch notifications, and occasional venue or event updates related to the Service.
- Improve and debug the Service.
- Comply with legal obligations.
3. SMS and Text Messaging
When you submit your phone number on our waitlist form, you consent to receive SMS messages from Kloü at that number. Message frequency varies. Message and data rates may apply.
We do not share your phone number or SMS opt-in status with third parties or affiliates for their marketing or promotional purposes. Mobile information will not be shared with third parties for marketing or promotional purposes. Information sharing to subcontractors in support of our services (for example, our SMS delivery provider) is permitted only to the extent necessary to operate the Service.
You can opt out of SMS at any time by replying STOP to any message from Kloü. For help, reply HELP or email gabe@klou.app. Opting out will stop future marketing and transactional SMS, though we may still contact you for account-related matters by email.
4. How We Share Information
We share information only with:
- Service providers who help us run the Service (for example, our SMS carrier, hosting provider, email delivery provider, and analytics) under contract and only to perform services on our behalf.
- Law enforcement or legal requests when required by applicable law, subpoena, or court order.
- Successor entities in the event of a merger, acquisition, or sale of assets, subject to this Privacy Policy.
We do not sell personal information. We do not share phone numbers or SMS opt-in status with third parties for marketing.
5. Data Retention
We retain waitlist information for as long as you remain on the waitlist or use the Service, and for a reasonable period afterward to comply with legal, tax, and audit obligations. If you opt out of SMS, we retain a record of your opt-out indefinitely to honor it.
6. Your Choices
- SMS opt-out — reply STOP to any message.
- Account deletion — email gabe@klou.app to request deletion of your waitlist record.
- Access and correction — contact us at the email above to access or correct information we hold about you.
7. Security
We use commercially reasonable measures to protect the information we hold. No system is perfectly secure; we cannot guarantee absolute security.
8. Children
The Service is not directed to children under 18. We do not knowingly collect personal information from anyone under 18. If you believe a minor has provided us information, contact us and we will delete it.
9. Changes to This Policy
We may update this Privacy Policy from time to time. When we do, we will update the "Last updated" date above and, if the change is material, provide notice through the Service.
